2. This contract shall be effective on the date Outfitter receives Client’s deposit and the contract is signed by both parties. The parties (Outfitter and Client), in consideration of the mutual promises contained herein the parties agree as such terms and conditions are set forth herein. 

3. The Outfitter Agrees to/that: 

3.1. Be insured, bonded and licensed/permitted as required by the appropriate State and Federal regulation, wildlife management and land management authorities, including

but not limited to Division of Professions and Occupations (DPO), Office of Outfitter Registration; Bureau of Land Management; Colorado Division of Wildlife and/or the U.S. Forest Service as the same may be applicable.

departure dates, and other reasonable information requested by the Client pertaining to the trip.

3.10 Check-in for the hunt at 9:00 A.M. Check-in at the hunting camp for lodging will be after hunter orientation. Lodging and all meals will be furnished at 

the outfitters facilities for the remainder of the hunt. 

3.11 All provided lodging facilities are in a safe, orderly, and sanitary condition, and that all lodging facilities are in compliance with applicable federal, state, and local land use regulations. 

3.12 To provide clean, fresh drinking water, protect all food from contamination, and to properly dispose of any and all garbage, debris, and human waste. 

3.13 Outfitter will not provide any personal gear, hunting gear, any firearms or ammunition, and/or  hunting or fishing licenses, and Client will provide their own equipment for the services, and make the arrangements to acquire the appropriate license or tag for the performance of this contract. 

4. The Client Agrees: 

4.1. To pay all fees when due and furnish all required information by the dates promised. 4.2. To live and camp in a manner consistent with local and state laws and regulations, U.S. Forest Service regulations, and abide by camp and other rules as provided by the Outfitter, be familiar with the current Colorado Big Game Guide, and be familiar with all current regulations regarding hunting activities in the State of Colorado. 

4.3. To make arrangements for and pay any expenses for the processing costs, commercial trophy care, and shipment of any meat, hides, antlers, or trophies; Client acknowledges that Outfitter does not provide field caping of game animals, and that Outfitter is not responsible for any meat, hide, teeth, cape, and/or antlers after removal from the field, while being processed by the hunter at camp, or after delivery to a commercial

processor. 

4.4. To acquire and pay all fees for the required licenses, habitat stamps, any other license fees required, unless they have made previous arrangements with Outfitter for the purchasing and acquiring the required license or habitat stamps. 

4.5. To arrange for travel to and from _Murphy Ranch_. Clients are 

responsible for making their own transportation arrangements and for payment of transportation cost of any travel or moving any supplies to camp. 

4.6. To bring sufficient but not excessive amounts of personal gear based upon the list provided by Outfitter. 

4.7. That if born after January 1, 1949, be in possession of a Hunter Safety Card. 4.8. Outfitter makes no guarantees or assurances as to the success of the activities herein stated. 

4.9. To refrain from consuming any alcoholic beverage during the day or otherwise until all firearms are unloaded and stored for the day—absolutely no drinking of alcohol before or during hunting activities. 

4.10. Any equipment provided by Outfitter for Client is in a clean, safe, serviceable and sufficient condition, and adequate for the performance of the services contracted for. 4.11. Youth hunters under age 16 must be accompanied by a parent and/or legal guardian at all times during the hunt. Parents and/or legal guardians must be a licensed hunter and/or meet hunter education requirements for the State of Colorado. 4.12. That a bullet SHALL NOT be loaded in the guns chamber while walking or while riding in a motorized vehicle, ATV or on an animal. This is extremely dangerous due to rough, steep and sometimes wet terrain. 

4.13. That hunting activities may involve walking and hiking, sitting, still hunting, climbing, extreme exertion, riding in 4X4 vehicles or ATV’s, and any and all of these activities taking place before, during, and after daylight hours. 

4.14. The elevations encountered range from about 6300 feet to about 8200 feet above sea level. Weather conditions can be and are unpredictable. Client may experience wind, rain, snow, fog, sub-zero temperatures, extreme heat, icy conditions, mud, or any

combination of the above conditions. The terrain ranges from moderate to very rugged and demanding. Habitat cover and openness are extremely varied. If in the opinion of the Outfitter, weather conditions constitute a hazard or danger to Client or others, the Outfitter reserves the right to temporarily suspend all activities until conditions change sufficiently to allow safe conduct of activities. 

4.15. To allow Outfitter to cooperate in any investigation conducted by the Colorado Department of Regulatory Agencies (DORA), including an investigation into an alleged violation of the Outfitter Rules provided by DORA, the provisions of Article 55.5 of Title 12, and Article 6 of Title 33 of the Colorado Statutes. 

4.16. To waive and release Outfitter from any claims that may arise out of a violation of Chapter 4 “Responsibilities, Professional Conduct and Prohibited Conduct” of the DORA’s Outfitter Rules. 

4.17. To pay all expenses related to or arising from Chronic Wasting Disease (CWD) in an Elk or Mule Deer, including but not limited to all costs for shipping and testing an animal with Colorado Parks and Wildlife. 

4.17.1. Client recognizes that CWD is a naturally occurring condition and is outside of Outfitter’s control and as such Client acknowledges that Outfitter is not responsible for the taking of an animal which is found positive for CWD, nor is Outfitter responsible for any negative effects attributable to a CWD positive animal. 4.17.2. Client will not be entitled to a refund under this contract, nor will Client be entitled to take another animal under the terms of this contract if it is later determined that Client took a CWD positive animal. 

4.18. To read and sign the attached Accident Waiver and Release of Liability form. All forms must be returned to Outfitter on or before hunter orientation.
